Taverns Slaughtered By Harrisburg Votes And Policies


A few tavern owners approached me about the business climate in Pennsylvania. There has been so much attention focused on the severance tax mainly due to the election that their plight has largely gone unnoticed,... except by SOP.

Look around your community and take inventory on how many libation establishments closed over the last two years. I've heard from bar and tavern owners from Plains to Hazleton. According to one owner, James Christman, who is quoted later in this post over 900 establishments in this state have closed over the last year. Imagine how many jobs were lost.

The three biggest detriments to their livelihoods have been the Mohegan Sun Casino, inequitable application of the smoking ban, and the failure of the legislature to pass the small games of chance legislation so desparately needed to keep libations near and dear to home.

The policy makers in Harrisburg have their heads buried in the sand. First, the more establishments that close the farther someone who has had libations has to drive under the influence. Okay so they aren't supposed to but let's cut the b.s.; it happens on a daily basis. Farther driving distances also mean that many will simply decide to stay home leading to less sales and inevitable closure. When those situations happen, the state is the ultimate loser of revenue, at a time when it is trying to tax the heck out of us because it needs money.


Now, the Pennsylvania Liquor Control Board is deciding to raise its handling fees at its warehouses on liquor according to this report from the Post-Gazette.

For the first time in 17 years, the state Liquor Control Board has decided to increase its "handling fees'' starting Jan. 4, citing higher costs for shipping, storage, transportation and marketing of its products.

Price increases will vary from product to product, but could be about $1 to $1.50 per bottle (depending on the size) on the several thousand varieties of wine and spirits sold at the 620 state-owned liquor stores, as well as higher prices for drinks by the glass at your neighborhood watering hole.

LCB chief executive officer Joseph Conti, at a state Senate committee hearing in late September, said he sees the price changes more as "readjustments'' than "increases," and said they are "both reasonable and necessary."

He told the panel, which is chaired by Sen. John Pippy, R-Moon, that it's "critical to understand that the board has not increased the [handling fees] for 17 years, despite increased operational costs and continuing upward pressure on prices from the board's [liquor] suppliers."

But Kevin Joyce, owner of The Carlton restaurant Downtown and past president of the Pennsylvania Restaurant Association, is upset at the increases, which he said many bar and restaurant owners didn't learn about until August.

He said higher drink prices mean people in the hospitality industry must either absorb the increases or anger customers by raising prices.

"Wine and spirits are 'raw materials' to bar and restaurant owners, and we already pay more for these materials than we would if we were doing business anywhere else in the world," Mr. Joyce complained.

These cost hikes, he added, come on top of "an extraordinary array of taxes and fees on wines and spirits sold in [state] stores, driving up costs that impact both licensed restaurants and the consumer public."

A national group, the Distilled Spirits Council, called the price increases "a stealth tax that will cripple Pennsylvania's struggling industry and pick the pockets of unwitting consumers."

Council vice president Frank Coleman said the LCB's decision "to jack up fees on wine and spirits amounts to taxation without representation. We urge the PLCB to roll back this measure that will only further damage the hospitality industry during the worst economy since the Great Depression."

The Democrats call the Republicans the party of "NO". Well it is the Democrats who are saying NO to partying. In this press release from the Pennsylvania House Repuiblican Caucus it urged legislators to pass legislation permitting small games of chance in taverns.

Senate and House lawmakers from both parties joined tavern owners, private club operators and emergency responders today to urge passage of legislation that would allow small games of chance in taverns.

House Bill 2379 and its companion Senate Bill 1301 would expand the Local Small Games of Chance Act to include licensed establishments like local bars and taverns and private clubs.

Pennsylvania faces several fiscal challenges in the weeks and years ahead, prompting a sense of urgency to bring these measures before the full Senate and House for debate, said state Sen. Mike Stack (D-Philadelphia). The 2010-11 budget assumed that the state would receive $850 million in federal Medicaid funding from Congress. However, the state received less than anticipated, which leaves the new budget with a $280 million hole.

In addition, the expiration of the federal American Recovery and Reinvestment Act stimulus funds will create a $2.3 billion gap in funding next year. Plus, other structural funding problems have led some to predict that the structural deficit will be as much as $5 billion next year.

“We don’t know if the Marcellus Shale tax will be approved and we’ve already made numerous painful cuts to the budget. We can’t just cut and slash our way to fiscal solvency. We need to find a new source of revenue,” Stack said. “Legalizing small games of chance in taverns and private clubs is a common-sense way to generate millions of dollars for the state without burdening taxpayers.”

The Citizen Voice printed this observation in a story from July.

Under House Bill 2379, taverns would turn more than 30 percent of their small games proceeds to the state. The amount would be split between the State and Public School Employees retirement systems, which are expected to have a multi-billion dollar deficit by 2012.

An additional 20 percent assessed on proceeds would be earmarked for a "charitable organization to be used for a public interest purpose," according to the House bill. Qualifying organizations would include fire companies, veterans groups and local athletic programs.

Taverns would keep the remaining 50 percent.

The Senate version is similar, but would allot 30 percent of the revenue to the state's general fund. The contribution to charitable organizations would be the same amount, however, an additional 2 percent would be split between the Pennsylvania State Police and the Department of Revenue to cover enforcement and administrative costs related to the law. The tavern would keep 48 percent.

Neither bill calls for taxing small games of chance at civic groups, veterans clubs and other nonprofit organizations.

The House bill was referred to the House Gaming Oversight Committee in March. The Senate version has been sitting in that chamber's Finance Committee for about the same amount of time.

Christman said the bills, if passed, "certainly wouldn't decrease" bars' bottom lines. He said taverns are hurting, with the latest estimates showing 900 bars have closed since the beginning of the year.

"If each of those bars employed five people - and that's a very conservative estimate - do the math. That's almost 5,000 people out of work," he said.

Christman, who admitted he's feeling the financial pinch, blamed closures on a number of factors, including the smoking ban and high insurances.

"What the small games of chance would do is probably save at least a few of us," said Christman, a member and former vice president of the Pennsylvania Tavern Association, a nonprofit group that lobbies for licensed liquor establishments in the state.


Look for tavern owner backlash at the Democrats on Tuesday. From what was told to me many lost significant revenue so they are intent to see that certain legislators have the same problem.

Barletta Speaks To NAACP


As the election fast approaches Lou Barletta made his pitch at a meeting of the NAACP yesterday held at Mount Zion Church in Wilkes Barre. Matt Hughes of the Times Leader wrote this observation.

Both Kanjorski and Barletta spoke at the NAACP’s Meet the Candidates Forum, held Saturday at the Mount Zion Baptist Church. Barletta arrived on time for the event and left before it ended; Kanjorski arrived after Barletta had already spoken and left.

Barletta outlined his economic policy of creating jobs by providing incentives for businesses to hire employees.

“The government doesn’t create jobs; businesses do,” Barletta said. “We have to get businesses going again so they can create jobs.”

Barletta slammed Kanjorski for not attending the meeting, as he believed Kanjorski would not attend, for refusing to hold in-person town hall meetings and for not participating in debates in each of the five counties in the 11th District as Barletta invited him to do. Kanjorski and Barletta debated once Thursday in Jenkins Township.

“One of the most important issues in this election … is that many people in our district feel that their voices aren’t being heard,” Barletta said. “He didn’t hold any town hall meetings and only did one debate. That’s not reaching out.”



Readers may recall in 2008 Kanjorski skipped out on the NAACP meeting held at East Stroudsburg University.

The reason why depends on who you ask. A campaign spokesman said Kanjorski had a scheduling conflict. But an event organizer said she was told Kanjorski objected to a Barletta press release earlier Wednesday charging Kanjorski is "afraid" to debate Barletta.

The result was that Barletta, the mayor of Hazleton, was the lone candidate to discuss his views and take questions from about 90 people — including elected officials and local activists of both parties — at Beers Lecture Hall. The forum, sponsored by the Monroe County NAACP and the ESU chapter of the American Democracy Project, also was broadcast on Blue Ridge Cable Channel 13.

Kanjorski instead went to a regional event for presidential candidate Barack Obama's campaign workers in Scranton.


What wasn't in that report was the fact that Kanjorski had actually pulled up to the East Stroudsburg University event and left. Participants relayed they saw Kanjorski to event organizers.

Another little known fact centers on how Kanjorski won his office in the first place. In the primary of 1984 Kanjorski defeated then Congressman Frank Harrison. Harrison died last year. Here is a link to a story about Harrision.

Former Rep. Frank Harrison (D-Pa.) died this week at the age of 69. He was found dead in his Galveston, Texas, apartment, according to media reports in Pennsylvania. He reportedly died of natural causes.

A lawyer and college lecturer in northeastern Pennsylvania before being elected to Congress, Harrison served in the House from 1983 to 1985, seeing his political career cut short when now-Rep. Paul Kanjorski (D) defeated him in the 1984 Democratic primary.

Kanjorski, D-Nanticoke, provided an e-mailed statement on Harrison’s unexpected passing.

“As we mourn the loss of Congressman Frank Harrison, I pass along my thoughts and prayers to his family and friends,” Kanjorski said.

“Frank and I knew each other as college debaters.

During his time at King’s, Harrison helped run the debate team. He was an avid debater at St. Mary’s and King’s and enjoyed working with young people and piquing their interest in debate, said friend Gene Brady, who is executive director of the Commission on Economic Opportunity.

“I think he believed in the public discussion of issues and everyone’s right to their opinion,” Brady said. “He was a very intelligent person … He just had a great intellectual curiosity.”


Guess it must be Republicans Kanjorski doesn't like to debate. At least Harrison saw the importance of public discussion.

In that article comments from The LuLac Political Letter were chronicled.

As the 1984 Democratic primary approached, Harrison found himself in the middle of a few obstacles. The first was the division of the Democratic Party. Eugene Hudak, the Luzerne County Clerk of Courts was angry at the local Democratic leadership of former Senator Martin l. Murray. Hudak was a long time antagonist of the Democratic power structure. Efforts to defeat him were useless since he always came out of Nanticoke with a lion’s share of votes. Hudak got behind his fellow hometown boy Paul Kanjorski who was now making his third run for the seat of Dan Flood. In the meantime, in the fall of 1983, local residents were plagued with a water crisis. Apparently some type of bug got into the water supply and residents fell prone to the disease dubbed giardiasis. As the locals were boiling their water in big pots and pans, Harrison was on a Congressional trip with the Democratic delegation to the Costa Rica to study international relations in Latin America. Even though it was an honor to be selected by the leadership for the trip, the perception of the Congressman jetting off to a sunny land while his voters back home dealt with a harsh winter and bum water was not a good omen for Harrison.

In that 1984 primary were Harrison, Kanjorski, Gene Knox and Steve Flood. Kanjorski picked as his political consultant Ed Mitchell who earlier ran for a seat in the 10th Congressional District against Joe McDade and competed for Flood’s seat in the 11th against a crowded field in the early rounds of Harrison vs. Kanjorski. Harrison had as his consultant Bob Kutler, a Washington D.C. operative known for not wearing socks and not suffering fools gladly. Kutler bragged about not knowing the local political power brokers while Mitchell massaged them onm a regular basis. Mitchell also put together a series of fast paced ads featuring Caribbean music in the background asking the question “Where Was Frank?” referring to the Congressman’s foreign affairs trip.

The ads resonated and put Harrison on the defensive. He never recovered. Kanjorski was portrayed as the local, hometown earnest young lawyer from the ultimate coal town, Nanticoke while Harrison was tagged as a Harvard educated elitist who had lost touch with his district. At the time, Ed Mitchell was quoted as saying, “We fundamentally controlled the dialogue throughout the campaign, framed the debate and kept Harrison on the defensive.” On election day, Kanjorski won his hometown by 3,000 votes (Nanticoke) while Harrison carried Wilkes Barre by only 700 votes. District wide, Kanjorski won by 2,000 votes and never looked back serving in Congress since 1984. “We ran a poor campaign for a lot of reasons” said Ungvarsky. “What we couldn’t translate to the voters was the importance future assignments Harrison would be in line for by his relationships with the House leaders. The problem was it did not transfer over to the voters. Harrison always felt that while Dan Flood built a tremendous base for the district in terms of roads and hospitals, the role of Congressman should be looking at a larger economic picture and not putting band aids on problems already in place. His vision was a bit different and perhaps he was too cerebral for the taste of local politicos. Harrison wanted to look beyond the coal fields heritage and truly expand the area to big Fortune 500 companies but he never got the chance to play out his vision” said Ungvarsky. David DeCosmo, former radio and TV journalist, who ironically broke the Giardiasis story remembers Harrison “As a straight forward guy”. He said, “Harrison recognized the political climate at the time. Whoever was going to succeed Flood could expect to be there a long time. He always answered every question put to him, was very opinionated even if that was often at odds with the general consensus of the time, was very available to all of the media and at the heart of it all was a very, very kind man”. DeCosmo agreed that it was Giardiasis, with its wide ranging implications, brought down the career of Frank Harrison. (Not to mention launching the career of Ed Mitchell as a political consultant).

The three time political battles between Kanjorski and Harrison are often compared to a local version of the Ali-Frazier heavyweight match ups.


It cracks me up everytime I hear someone say Barletta would be finished politically if he loses to Kanjorski this time. Kanjorski lost two times before defeating Frank Harrison. Three times may be a charm but four may mean more.

What's Wrong With Our Schools


Voter backlash over the promise of property tax relief in Pennsylvania is genuine. A little known fact is at the bottom of it. Most of our property tax relief was given to school districts. A small portion is received to those who FILE for the Homestead Act reduction. If you don't file it's snooze you lose.

Its a struggle in this state between the taxpayers and the unions. The unions lobby heavily in the Legislature for their agenda. In this case they were able to get the Legislature to steer our money to school districts so that contract negotiations could include better pay and benefits. Mind you better pay is what we all aspire for but in this case it is not tied to performance.

Read this story that appears in today's Wall Street Journal titled "The Education Manifesto". Learn how two people, one a politician made the selfless choice to fix what was wrong with the Washington D.C. school system at their peril. It teaches all of us what is necessary to accomplish the goal of better education for our children, rewarding the good teachers and getting rid of the bad ones. The Legislature should abolish tenure in the school systems.

Speaking of Chutzpah

Eachus Hired Admitted Felon Robert Powell's Attorney Firm


In Jewish they would call this chutzpah. For the past month House Majority Leader Todd Eachus and the Pennsylvania Democratic Campaign Committee have been malicously attacking Tarah Toohil for representing a barber in Luzerne County Court. In addition they tried to tie her to one of the attorneys representing a judge in the Luzerne County corruption scandal just because his office is in the same building as Attorney Toohil's private solo practice.

In this article which appears on Law.com dated February 25, 2009 Attorney Richard Sprague from Philadelphia is mentioned as representing now admitted felon Robert Powell in that very case cited by Eachus and his politcal party campaign caucus.

Stacey Witalec, a spokeswoman for the Pennsylvania Department of Public Welfare, said the department's records show attorney Robert J. Powell, of The Powell Group in Drums, Pa., and Western Pennsylvania investment banker Gregory R. Zappala were owners of PA Child Care. Powell sold his interest in the company to Zappala last year, Witalec said.

The Citizens' Voice, a Wilkes-Barre, Pa., newspaper, has previously identified the builder as Robert S. Mericle, owner and president of Mericle Construction Inc.

A day before the judges appeared in federal court, attorneys for Powell acknowledged he was the former co-owner of the detention centers identified as Participant No. 1.

In a letter signed by Mark B. Sheppard of Sprague & Sprague in Philadelphia, Powell's lawyers said he had been unfairly portrayed in news reports on the corruption probe.

"First, it is grossly inaccurate to suggest that our client ever sought or had any influence in the sentencing of any juvenile offender. In fact, Bob Powell never offered to pay a single penny to these former judges. Instead, Bob Powell was a victim of their demands for payment," the letter says.

The letter goes on to say that, although Powell recognizes he made a mistake by not going to authorities, he remained silent about the judges' demands because they exerted pressure on Powell and his clients.

"The record will show that despite this, Powell not only refused the Judges' continued demands for additional payments, but ultimately reported the conduct to authorities," the letter says.

The letter, also signed by Richard A. Sprague and Geoffrey R. Johnson, says Powell is continuing to cooperate with authorities and is integral to the U.S. Attorney's prosecution of Ciavarella and Conahan.


On November 03, 2008 the House Democratic Caucus led by Todd Eachus hired Sprague and Sprague in a contract numbered HDC01111008 potentially worth $100,000.00. This contract provides for Sprague and Sprague to furnish legal services to the House Democratic Caucus. Total compensation for this contract shall not exceed $100,000.

The contract has no end date so presumably the HDC is still a client of Sprague and Sprague. Click on this link to the actual contract.

The audacity of the Eachus camp to employ such a stupid tactic with this information readily available to the public is mind boggling. Eachus actually hires Powell's attorney and he wants to tie Toohil to something just because she shares the same office building address as another attorney. Eachus flies for free on Powell's jet but he has the effrontery to open up this subject. Chutzpah,nahhh...arrogance, unashamed boldness, stupidity..closer...

Eachus's Potential Ethics Problems Over "Air Corruption" Flights


In what is being labeled as a case of "jet lag" House Majority Leader Todd Eachus is being taken to task over his bogus claims that he didn't have to report flights he accepted from now admitted felon Robert Powell aboard his jet, earning the Pulp-Fiction like name of "Air Corruption". Steve Mocarsky penned this story today in the Times Leader.

Eachus said he wasn’t required to report the flight on his 2007 filings with the state Ethics Commission because “it was in the act of work, at least the way I consider it.” He initially said the value of the flight was “below the reporting threshold."

Dave Georges, Eachus’ campaign spokesman, said legislative counsel told him last week that the flight did not have to be reported because it “was taken in the discharge of his duties and he did not profit from it personally.” He said last week the 2007 flight was the only one Eachus made on the jet.


If legislative counsel, which SOP previously reported at 12 firms with 27 contracts and amendments, gave advice Mr. Georges should produce the written opinion. Eachus, like his former boss Paul Kanjorski, must feel he can make up his own rules.

Here's what others have to say on the matter.

Steve Miskin, House Republican Caucus spokesman, said the trip should have been reported. “When you attend a press conference, you are deriving a benefit. You get your picture in the paper, you get on the news; that’s a benefit,” he said.

Robert Davis Jr., a Harrisburg attorney who limits his practice to attorney ethics matters, said he has had clients who were confused about the instructions.

“A fair reading … would leave people wondering whether to report it or not. … But I would think the better judgment would be to list it,” Davis said, adding it might be difficult to determine the value of the flight or flights.

Dick Denison, president of Denison Jet Sales, Greer, S.C., was hired to sell the jet in 2009. He estimated the cost to operate the plane at about $2,000 per hour.

Capt. Ross Aimer, CEO of Aviation Experts LLC, San Clemente, Calif., agreed with the $2,000-per-hour figure and estimated the flight time from Hazleton to Harrisburg at 12 minutes, from Hazleton to Allegheny County at 45 minutes and Allegheny County to Harrisburg at 20 minutes. But charges begin from the moment the plane is powered up until the engines are turned off, which could add half an hour to an hour to the calculations, he said.


Can Mr. Eachus explain to the public how attending a private firm's media circus is part of HIS legislative duties?

Tarah Toohil, Eachus’ Republican challenger for his seat in the 116th Legislative District(and an attorney), said Eachus should have reported both flights on his ethics forms. “We have a real problem with a lack of ethics here; that’s very apparent.”

By SOP's calculations the cost of these particular double round trip flights approaches $3,000.00. The jet flew to Harrisburg to pick Mr. Eachus up and bring him to Hazleton. Then it took him back to Harrisburg and returned to Hazleton. Do your own calculations based on the information from the aviation experts and see if Mr. Georges and Mr. Eachus pass the smell test?

Barletta Vs. Kanjorski Part 2


In the next part of the debate between incumbent Paul Kanjorski and challenger Lou Barletta healthcare became the topic of discussion. Moderator Bill Kelly went to Andree Phillips for the question. She stated she went to a meeting yesterday comprised of senior citizens. She "voir dired" Kanjorski about their concerns over insurance, Social Security and their coverage over provisions found in Obamacare. "I can tell you there were 30 people in that room and they were all afraid, they were afraid because they see their Medicare premiums going up and their coverage going down." "What are you going to do to improve that situation for our senior citizens?"

Kanjorski's response "First of all I want to tell 'em and I am sorry you couldn't tell 'em that the present law passed has no effect PRESENTLY on their premiums going up or their services going down. The law hasn't been put into effect and won't go into effect for 4 years. So any impact on healthcare costs in the United States have nothing to do with the healthcare bill passed by the law recently." His platitudes went on to bring in pre-existing conditions. He also made the claim "In this country 1 in 5 employees are imprisoned to their job and are in economic serivitude as a result of the failure of healthcare and coverage in the United States. That is horrendous.  I've been in Congress long enough to see the Clinton's try to get healthcare 15 years ago and a failure. Now President Obama brought it through, we carried it through but always with the understanding just as we did with Social Security and Medicare, that adjustments and changes will have to be made in Amendments to make sure this very complicated Act actually works. In affects 17% of our Gross Domestic Product." He rambled on about touting some benefits of the act including "making it more efficient for companies to operate in this country" and "closing the hole on drugs in this country".

Then he said "And quite frankly the Health Act has no ramifications or application to Medicare that senior citizens are under....I just want to leave with one thing. Anyone watching this debate tonight. Be sure of one thing. If you are a senior citizen, if you are under the protection of Medicare you will not be impacted in any way negatively by what the Congress has done". Moderator Kelly called the time on his response at this point.

Barletta countered "Who believes that thirty million more people will be included in the healtcare plan and we are actually going to save money because the federal government is going to run it. Nobody believes that, nobody believes that will happen at all. As a matter of fact Congressman we already saw the effects of your vote on the healthcare bill when Mercy Hospital announced, uh, is talking about selling their three Catholic hospitals, uh, as part of the decision is based on the effect that Obamacare will have on the hospitals. This healthcare bill will chase doctors out of business."

Seniors who retain Medicare Advantage plans in 2011 should not be fooled into thinking that they have dodged Obamacare’s cuts to Medicare. Unless Obamacare is repealed, their time will come.

What did Paul Kanjorski tell seniors?

Was that Kanjorski's second damnable lie? He is listening to his mentor, Nancy Pelosi. Of course she was the one who said "But we have to pass this bill so you can find out what is in it".


Protecting Medicare??? Actually not, just hurting seniors.

WVIA Congressional Debate Between Lou Barletta And Paul Kanjorski


WVIA-TV sponsored a debate between 11th Congressional opponents Lou Barletta and Paul Kanjorski. In viewing the tape of the program it begs some fact checks on statements made by Congressman Kanjorski against Mayor Lou Barletta.

Kanjorski stated that the "FBI was in Hazleton at this very moment" investigating the site of the mine reclammation project remediating the toxic waste of the former Hazleton Landfill of the 70's. In fact there is NO FBI investigation of that site, period. While the FBI seized files from operators at that site, their investigation has nothing to do with the actual site as proffered by Kanjorski. Further more, there has been no new developments in that seizure. Speculation abounded at the time that they were sent there by supporters of Kanjorski but have yet to be confirmed.

Lou Barletta attacked Paul Kanjorski over his vote for amnesty in 1986. Kanjorski stated there is "Congressional record that states I voted against amnesty and thats a damnable lie".   Kanjorski said "that's a matter of checking the Congressional Record."  Let's do that.

A "Y" indicates that a congressman voted "Yea"; an "N" indicates that he voted "Nay", and a "?" indicates that he did not vote. A blank space indicates that he was not in Congress during 1986.


Immigration Reform and Control Act (IRCA) of 1986. This legislation (S. 1200) granted amnesty to roughly three million illegal immigrants for the stated purpose of solving the immigration problem and securing our border. The enactment of the Immigration Reform and Control Act (IRCA) dramatically eroded border control not only by granting citizenship to millions of illegal immigrants but by encouraging millions more to enter into the United States illegally in the hope that they too would eventually receive legal status. Twenty years later, there are now an estimated 12 million illegal aliens in this country, and many congressmen--including some who voted for the 1986 amnesty--are again arguing that the means to relieve the pressure on the border is to legalize the illegal aliens. The House passed the final version of IRCA on October 15, 1986 by a vote of 238-173 (Roll Call 433).

As I review the debate I will point out more of the fallacies spread by Paul Kanjorski.

Eachus- Frequent Flyer On Air Corruption?


In today's Times Leader there is a story by Steve Mocarsky that questions Todd Eachus's claims that he only received one ride on now admitted felon Robert Powell's jet, media coined "Air Corruption".

Contrary to a statement from state House Majority Leader Todd Eachus’ spokesman, Eachus made more than one flight on a jet owned by admitted felon Robert Powell, according to sources.

Eachus, D-Butler Township, was aboard the 1981 Sabreliner 65 for at least part of a flight from Hazleton to Allegheny County to Harrisburg, back to Allegheny County and back to Hazleton on Dec. 27, 2006, the sources said.

Last week, Eachus confirmed that he took a round-trip on the jet from Harrisburg to Hazleton and back for a press conference to announce a development plan for a cargo airport near Hazleton on Jan. 31, 2007.

Through his campaign spokesman, Dave Georges, Eachus said last week that was his only time on the jet.


For months SOP has been reporting that close sources relayed similar information about multiple flights. It isn't so much that Eachus flew on Powell's jet. It is the fact that he failed to report it on his Ethics Commission filings. Only he can answer why.

Clinton Can't Remember Where His Wife Was Born


Yesterday former President Bill Clinton came to Nanticoke, Pa. to stump for his long time friend Paul Kanjorski. Although Elvis was sighted in the crowd no one saw Monica Lewinsky. It might be a good thing.

Andrew Seder of the Times Leader reported that Clinton forgot where his wife was born.


Clinton, as he always does when appearing in the region, reminded people that his wife, Secretary of State Hillary Clinton, was born in Scranton and still has relatives in the area.

She was raised in a United Methodist family, first in Chicago and then, from the age of three, in suburban Park Ridge, Illinois. Clinton Stumping For Kanjorski

It's old news that Bill Clinton came into Nanticoke yesterday to stump for Paul Kanjorski.

A little observation about Clinton by John Baer today. The article is discussing voting trends in Pennsylvania over the years.

In 1994, Clinton was seen as more liberal as president than as a candidate and got hammered over deficits and health-care reform (sound familiar?). Democrats lost 54 House seats, eight Senate seats and control of Congress.

Democrat Vs. Republican Control Of Congress- Who Really Created The Deficits

A discussion on politics invariably hits the topic of deficits and who was in power during those deficits. Obama and Kanjorski talk about Bush's spiraling deficits. It is time to set the record straight. Look at this chart which can be found at this link. It didn't come as clear as I wanted it to in PowerPoint conversion but the frst column is YEAR, the second Congress Number, next the President, the next column is Senate, and the final column is the House.


As you can see during those Clinton years where everyone feels the country was much better off than during the Bush years the Republicans were in control most of the time in the House and Senate.

Conversely when you look at the Bush years the picture isn't so clear until you look at this chart.


As you can see the deficits under Bush weren't as drastic until his last two years when the Democrats took control of Congress. One could never legitmately make the claim they "spiraled" out of control while he was in office.

Everyone blames Bush when in fact it was the Democrats who caused the deficits. The deficits greatly increase under Obama, Pelosi, and Harry Reid. The rest of that chart are projections. Under the present economic conditions they won't be born out.

It was the Democrats through the guise of wanting "affordable housing" that created the housing crisis and contributed to the economic crash of the present. The Community Reinvestment Act was passed in 1977. Instead of affordable housing it created "unaffordable mortgages".

Kanjorski's rank partisanship fails to recognize that there were more Democratically controlled Congresses during his time in office than Republican. Yet he wants to blame everything on the Republicans.

The question I have in this particular federal race is whether there is an in-kind contribution is a consideration for the use of the school in this event. Federal races have many different rules than state races. I guess it is okay to keep God out of our schools but Bill Clinton is more than welcome.

HARRISBURGA recent poll released by the Pennsylvania House Republican Campaign Committee shows State House candidate Tarah Toohil leading Rep. Todd Eachus by 5 points as Election Day nears.

"It's clear the voters in the 116th legislative district are looking for a candidate who's willing to take on the entrenched establishment, fight for the interests of our community, publically stand up to discuss the issues, and a leader who won’t hide behind staff or attack mailers,” Toohil said. Toohil surged ahead in the polls despite Eachus’ malicious attempts to discredit and harass her. In 6 days, Toohil's numbers moved from being behind 4 points to being ahead by 5 points. The newest poll of 800 voters was conducted on October 18th. The question asked "If the election were held today, would you vote for Tarah Toohil or Todd Eachus?" The Results: Toohil 49%, Eachus 44% with 9% undecided. The poll has a 3.5% margin of error.

Eachus Spent Taxpayer Money On Cargo Airport

In his debate with challenger Tarah Toohil on Channel 13, House Majority Leader Todd Eachus stated of the proposed cargo airport project by now admitted felon Robert Powell as one of the partners, "..not a penny of tax dollars went to that project."

On Friday, the Nanticoke Area School District sent a paid robo-call (click here to listen) from their Superintendent to the homes of parents with children in the district. The call warned them that a political rally for Congressman Kanjorski would be taking place at the Greater Nanticoke Area High School on Tuesday afternoon and would require the school to be closed early to accommodate the event.

Kanjorski Cuts Children Education In Nanticoke To Campaign

A developing story coming out of the Barletta campaign.

On Friday afternoon the Nanticoke Area School District sent a paid robo-call
from their Superintendent into the homes of parents with children in the district.

The call alerted them of a political rally for Paul Kanjorski that is to be held at the Nanticoke Jr. Sr. High School on Tuesday afternoon. It also said that the children's education day would be cut short due to Kanjorski's political rally and they would need to make accommodations to get their children.

Questions:

1. Why were taxpayer resources used to make this call?

2. Why did the call (paid for by the taxpayers) alert the recipients of a
political rally and not just an early dismissal?

3. Does Paul Kanjorski think it is right to cut a student's education day
short for his own political ambitions?

4. Did Kanjorski think about the inconvenience and hardship his rally would
cause to parents who have to leave work early or pay for extra child care so
he can have his campaign rally?

Guess this proves one point. Bill Clinton never campaigned on family values.  You can't have prayer at a school but you can campaign.  Go figure.


Someone should remind Anthony Perrone, the Superintendent, about the Hatch Act. The Act forbids employees of the federal government, as well as employees of state and municipal governmental bodies and agencies that receive federal funds, from running for office in partisan elections or participating in political campaigning while working.

From the Missouri Attorney General website:

In Fort v. Civil Service Commission of the County of Alameda, 392 P.2d 385 (Cal. 1964) the California Supreme Court ruled invalid a county charter provision that prohibited civil servants taking any part in the political management or affairs of any political campaign or election. The court said at page 389:


"No one can reasonably deny the need to limit some political activities such as the use of official influence to coerce political action, the solicitation of political contributions from fellow employees, and the pursuit of political purposes during those hours that the employee should be discharging the duties of his position.



It is unfair in this case for the Nanticoke School District to force opponents of Paul Kanjorski to lend financial support to the his campaign by use of their Jr./Sr. High School building. I believe it is also illegal for school personnel to release public employees from ordinary duties during the paid working day in order to allow a campaign to be conducted on school property.

The following information was provided to school personnel in California.

District staff and Board members should always bear in mind the potentially serious civil and criminal liability that may result from seemingly harmless actions. There is no “de minimus” level of public spending on a partisan campaign that would be acceptable under the applicable laws and rules. School districts should take steps to make clear to employees that they are not permitted to use any publicly funded, District-owned equipment for any political purposes in connection with the election, including District-issued cell phones, the District e-mail system, District-owned computers (including laptops issued to staff and used outside the office), phones, fax machines, etc. There are rare instances where the line is less than bright. However, a good guide may be that if the District prohibits or even discourages use of such resources for private purposes or conversations, it should definitely forbid any use for partisan campaigning.


The Commonwealth Procurement Code Contains Some General Ethics Guidelines in Commonwealth Agency Procurements.
Section 1103(a) of the Ethics Act similarly generally prohibits the use of government staff, time, equipment, facilities or property for non-governmental purposes -- including business, personal or political purposes. Isn't that what Bonusgate was all about? Look at this Order by the Pennsylvania Ethics Commission against Stephen Freind relative to conducting campaign activity using his state office.

Eachus Knew About Problems With Powell's Juvenile Facility In 2006- Casino Connection



In the Channel 13 debate between House Majority Leader Todd Eachus and formidable challenger Attorney Tarah Toohil, Eachus made the claim that he broke off ties with Robert Powell over the proposed cargo airport outside of Hazleton once he found out about the corruption. He also stated that "..not a penny of tax dollars went to that project."

Let's examine his claims and see if they pass the smell test.

First, the picture above is a scan of a disc/dvd presented to the press and attendees at the press conference held January 31, 2007 at 1:00P.M. to announce the proposed cargo airport by partner/now admitted felon Robert Powell. As you can see it was produced by the Legislative Communications Office and contains the "Seal of the House of Representatives". That proves Eachus lied about "not one penny of tax dollars went to that project."

Let's move on.

On October 14, 2009 the Interbranch Commission on Juvenile Justice held a hearing at the Pennsylvania Judicial Center in Harrisburg. Here is a link to the transcript of that hearing.

Todd Eachus's testimony begins on page 28 of that transcript.

He was asked "Are you aware of any complaints that have been filed wither with the Disciplinary Board, which regulates attorneys; the Judicial Conduct Board, which regulates judges,; or any other governmental investigative agencies?" Eachus's response was "No, I'm not. But to Mr.--one of the Commissioner's questions, asa a member of the Northeast delegation, it would have been around 2006, we were briefed by the Department of Public Welfare, and there were a number of people who came before the delegation to talk about the increased rates of incarceration at the juvenile level in Luzerne County."

"I think they would have been led by Mr. Cohn, who is the legislative liason for the Department, still is, for the Rendell Administration. I can't recollect exactly who the others were within the department, but there was a significant spike in incarceration which, you know, retrospectively today having conversations with the administration did not get through in a way that helped changed the system."

He goes onto state "It is troubling though that that kind of data from a state agency couldn't get through to the court system in order to help rearticulate a direction or review of the juvenile system in Luzerne County."

When asked if there was any follow up meeting Eachus conveys who the delegation was at the time. "It would have been Representative Phyllis Mundy; Kevin Blaum; who is now retired; a number of other members of Luzerne County and northeast delegation who would have been part of that briefing by the Department."

There wasn't much we could do about it legislatively because the interaction was administrative and they said not to worry, that they were going to handle it. But they wanted to raise the concern with the delegation.

Q: Mr. Leader, do you have constituents that came to your office registering complaints during the operative time frame regarding what was going on in the juvenile justice system in Luzerne County?

Eachus: I had one couple, and I'm happy to do some research to provide the information. I looked back at it. It would have been somewhere in 2006. A young couple came to me relating to incarceration of their daughter. It would have been a young girl in high school age.

Q: Could you tell us what you did?

Eachus: Well, I reached out to the court administrator....The family expressed to me that -- that the young lady was incarcerated for this theft, that she did not have any jewelry in her possession.

They were unaware that she stole anything, but the terms of the incarceration wre that if she did not return the jewelry, that she would stay in the detention center, the juvenile detention center in Luzerne County, for an indeterminate period, which I thought was a strange practice as related to how young people in the juvenile system would be incarcerated."

"I inquired. And I can't tell you whether my inquiry helped or didn't, but I can check back on my records."

I inquired but can't tell you whether it helped or not. Shesh.

That testimony is some of the most inculpatory words regarding knowledge of plain old "something ain't right here" that should spark the offensive flames in any father's mind.

Let's get to the timeline here.

On Jun 18, 2007 Representative Dwight Evans introduces a budget bill in the House. On June 28, 2007 Representative Todd Eachus offers an amendment to that bill inserting $250 million worth of funding for Powell's proposed cargo airport outside of Hazleton.

Eachus's claim that he broke off ties with Robert Powell once he found out about the corruption is classic misdirection to the public about his real knowledge. According to his sworn testimony he knew "things weren't right in Denmark" in 2006. His platitudes are incomprehensible and incompatible with common sense and basic values. He continued to accept contributions and rides on Powell's jet.

If you are still with this article there is more. As part of the House Democratic Caucus Mr. Eachus and Company hired the law firm of Sprague and Sprague, the same firm that represented admitted felon Robert Powell in 2008. He not only hired Richard Sprague but also sat in audience with him as Sprague "educated" him on the casino industry.

Sprague said his own outreach to legislators was limited to personal visits in 2008 with eight senators and representatives, including House Majority Leader Todd Eachus (D., Luzerne) and Senate Majority Leader Dominic Pileggi (R., Delaware).

"When I went to each of them," Sprague said, "my opening statement was 'I am here, and I don't want you to do a thing for me. . . . I'm here to introduce myself.' "

You may also recall the connection between Sprague, Powell, and other judges in the Luzerne County courthouse who testified against former Judge Ann Lokuta.

Betty Roccograndi of the Times Leader wrote December 7,2008 The links between Sprague, Powell, Conahan and other Powell pals who testified against Lokuta is disturbing, and any fair-minded person has to wonder whether Sprague’s objectivity was clouded even a little bit.

The Citizen's Voice printed this observation in May, 2010.

Richard A. Sprague, a prominent Philadelphia case, remained on the case despite representing former Drums attorney Robert J. Powell, who has pleaded guilty to paying kickbacks to two former Luzerne County judges.

That relationship has compromised Sprague's ability to conduct a fair and impartial hearing, Lokuta's attorneys, George A. Michak and Ronald V. Santora, said in an appeal filed today with the state Supreme Court.

The depth of the connections continue. Mark Sheppard, formerly of Sprauge and Sprague representing Robert Powell on former Judge Michael Toole.

When asked if Toole had taken a payoff from Powell, one of Powell's attorneys, Mark B. Sheppard, formerly of Sprague & Sprague and now a partner at Montgomery McCracken Walker & Rhoads, said he could not comment.

"It would be inappropriate for our client or I to comment at this time, except to say that Mr. Powell continues to cooperate fully with any investigation," Sheppard said.

Sheppard, along with other attorneys from Sprague & Sprague, had previously authored a letter released to the media in February disputing the notion that the money Powell paid to Conahan and Ciavarella amounted to kickbacks, and instead said that Powell was the victim of a judicial shakedown.

"First, it is grossly inaccurate to suggest that our client ever sought or had any influence in the sentencing of any juvenile offender. In fact, Bob Powell never offered to pay a single penny to these former judges. Instead, Bob Powell was a victim of their demands for payment," the letter said.


Got off the beaten path so back to the casino business.  Look how Eachus helped one particular casino.  Although Foxwoods is not part of the association where Sprague is involved this story may point to the reason tavern owners are having such a hard time getting small games of chance legislation passed in Harrisburg that would help save their industry and jobs.

How Foxwoods got a leg up

Time was not on the casino's side. Access to heavy hitters was.

Autumn was make-or-break time for the Foxwoods Casino in Philadelphia.

Opposition in neighborhoods and City Hall had stalled the project. Lenders had grown wary as casinos elsewhere struggled. State regulators set a final deadline: Foxwoods had to open by May 2011, or lose its license.

Foxwoods needed help in Harrisburg.

So its lawyer and lobbyist, Stephen A. Cozen, turned to an old friend whose campaigns he had generously supported: Gov. Rendell.

Then Cozen called on legislative leaders - Democrats Todd Eachus and Dwight Evans in the House, Republican Dominic Pileggi in the Senate. It was as if someone had drawn Cozen a map. Indeed, someone had.

"I advised him to talk to everyone in leadership, on both sides of the aisle," Rendell remembered.

By December, a 42-word sentence appeared on Page 55 of the 230-page bill to legalize poker and other table games at Pennsylvania casinos.

It said the state Gaming Control Board could extend a casino's license for "36 months . . . or December 31, 2012."

Those words spelled hope for Foxwoods' future.

Cozen said Gerber had suggested he talk to the House majority leader, Eachus (D., Luzerne). Later, Gerber began checking in with negotiators about the Foxwoods extension - not to lobby, Gerber said, but just to get progress reports.

An anxious Cozen phoned the House majority leader.

Eachus said Cozen had voiced concern about rising resistance from local lawmakers. (In a recent interview, Eachus defended the bill, saying casinos unbuilt meant state revenue uncollected. "It's a balance-sheet issue.")

He assured Cozen the Foxwoods language would stay..


I will end this post by returning to the open ended contract let out by the House Democratic Caucus to Sprague and Sprague in the amount not to exceed $100,000.00. It commenced on November 03, 2008 with no end date. The HDC was to inform the firm when it no longer needed its services.

Guess it didn't pass the smell test did it?
